Get StartedThis initiated amendment establishes a constitutional right to an abortion and provides a legal framework for the regulation of abortion. This framework would override existing laws and regulations concerning abortion. The amendment establishes that during the first trimester a pregnant woman's decision to obtain an abortion may not be regulated nor may regulations be imposed on the carrying out of an abortion. In the second trimester, the amendment allows the regulation of a pregnant woman's abortion decision, and the regulation of carrying out an abortion. Any regulation of a pregnant woman's abortion decision, or of an abortion, during the second trimester must be reasonably related to the physical health of the pregnant woman. In the third trimester, the amendment allows the regulation or prohibition of abortion except in those cases where the abortion is necessary to preserve the life or health of the pregnant woman. Whether an abortion is necessary during the third trimester must be determined by the pregnant woman's physician according to the physician's medical judgment. Judicial clarification of the amendment may be necessary. The Legislature cannot alter the provisions of a constitutional amendment.
A yes vote supports amending the constitution to establish a constitutional right to an abortion and provides a legal framework for the regulation of abortion.

"We're trying to restore the rights that women have had for the last 50 years, and that's why we have used the actual language of Roe v. Wade for the amendment. You know, whatever rights women had from Roe back in 1973, they will get when this thing passes and becomes part of our constitution." - Rick Weiland, Dakotans for Health, in support of Constitutional Amendment G (Learn more)
"It's about women's reproductive freedom. We had it. They took it away. We want it back." - Nancy Turbak Berry, chair of Freedom Amendment Coalition, in support of Constitutional Amendment G (Learn more)
"This fight is about saving the lives of countless unborn children in our state. We are grateful to the many dedicated volunteers who have put in countless hours, and we are resolute in our mission to defend unborn babies. We will continue to research these signatures and announce a challenge at the appropriate time." - Rep. John Hansen (R), in opposition to Constitutional Amendment G (Learn more)
"Constitutional amendments are serious and expensive undertakings that must be initiated after due diligence and input from those who would be impacted the most. As the sole abortion provider in South Dakota for more than 30 years, Planned Parenthood is acutely aware of the impact policy language can have on patients' lives. We stand with our partners at ACLU of South Dakota and do not support the amendment as drafted because we don't believe it will adequately reinstate the right to abortion in South Dakota." - Tim Stanley, Planned Parenthood North Central States, in opposition to Constitutional Amendment G (Learn more)
