Measure on the ballot in the 2023 South Dakota General Election.
The initiated measure would make the discharge of any treated water from the Custer Waste Water Treatment facility (sewage treatment plant) operated by the City of Custer, South Dakota, into French Creek or its tributaries, within the jurisdiction boundaries of Custer County, South Dakota, a nuisance and subject to laws of the State of South Dakota applicable to nuisances. South Dakota Codified Law currently defines ""private"" and ""public"" nuisances and establishes remedies against nuisances. The initiated measure would clearly define the discharge of treated water from the sewage treatment plant as a nuisance.
